Would it be possible to dismiss the unlawful weapon charge?
“This case is regarding CR, 21 years old and the night of his arrest was 1/11/26 after coming home from work. He was listening to music in his truck at his usual parking spot close to home. He was smoking cigarettes and “cooling off” from a long day at work suddenly was approached by cops. They flashed a light in the vehicle asked him what he was doing and to keep his hands up. They asked to search the vehicle C stated “if you think there is a probable cause” cop responded “yes” there’s an open can he was drinking, just that one while “vibing”. So they went ahead and searched. They found less than 2oz of marijuana, and a weapon, being his Gun. Gun was found in the compartment in the middle, and the weed was found in the back seat in a backpack. Would it be possible to dismiss the unlawful weapon charge?. There was no intent to use the weapon, the weapon was not “hot” or “clocked back”. It was loaded, was put up separately and he was allowed to have it.”

Defending Against Drug Charges
Every case is different. An experienced criminal defense attorney will carefully examine:
- Whether the traffic stop or detention was legal
- Whether police had probable cause to conduct a search
- Whether your constitutional rights were violated
- The handling and testing of the alleged controlled substance
- Whether the evidence is sufficient to support the charges
In many cases, challenging illegally obtained evidence can significantly improve the outcome of a case.
Why Early Criminal Defense Representation Matters
The earlier you involve a defense attorney, the more opportunities there may be to protect your rights. Early intervention can sometimes lead to reduced charges, dismissal opportunities, diversion programs when available, or stronger negotiations with prosecutors.
